Buna g\u00f6re; G\u00fcnl\u00fck i\u015fsizlik \u00f6dene\u011fi, sigortal\u0131n\u0131n son d\u00f6rt ayl\u0131k prime esaskazan\u00e7lar\u0131\u00a0dikkate al\u0131narak hesaplanan g\u00fcnl\u00fck ortalama br\u00fct\u00a0kazanc\u0131n\u0131n\u00a0y\u00fczde k\u0131rk\u0131d\u0131r. Bu \u015fekilde hesaplanan i\u015fsizlik \u00f6dene\u011fi miktar\u0131, 4857 say\u0131l\u0131\u00a0\u0130\u015fKanununun 39 uncu maddesine g\u00f6re onalt\u0131 ya\u015f\u0131ndan b\u00fcy\u00fck i\u015f\u00e7iler i\u00e7in uygulanan ayl\u0131k asgari \u00fccretin br\u00fct tutar\u0131n\u0131n y\u00fczde seksenini ge\u00e7emez.<\/p>\n<p style=\"text-align: justify;\"><b>\u0130\u015fsizlik \u00f6dene\u011finin verilme s\u00fcresi ve zaman\u0131<br \/>\n<\/b><\/p>\n<p style=\"text-align: justify;\">Hizmet akdinin sona ermesinden \u00f6nceki son 120 g\u00fcn prim \u00f6deyerek s\u00fcrekli \u00e7al\u0131\u015fm\u0131\u015f olanlardan, son \u00fc\u00e7 y\u0131l i\u00e7inde;<br \/>\na) 600 g\u00fcn sigortal\u0131 olarak \u00e7al\u0131\u015f\u0131p i\u015fsizlik sigortas\u0131 primi \u00f6demi\u015f olan sigortal\u0131 i\u015fsizlere 180 g\u00fcn,<br \/>\nb) 900 g\u00fcn sigortal\u0131 olarak \u00e7al\u0131\u015f\u0131p i\u015fsizlik sigortas\u0131 primi \u00f6demi\u015f olan sigortal\u0131 i\u015fsizlere 240 g\u00fcn,<br \/>\nc) 1080 g\u00fcn sigortal\u0131 olarak \u00e7al\u0131\u015f\u0131p i\u015fsizlik sigortas\u0131 primi \u00f6demi\u015f olan sigortal\u0131 i\u015fsizlere 300 g\u00fcn,<\/p>\n<p style=\"text-align: justify;\"><b>S\u00fcre ile i\u015fsizlik \u00f6dene\u011fi verilir.<br \/>\n<\/b><\/p>\n<p style=\"text-align: justify;\">\u0130\u015fsizlik \u00f6dene\u011fi her ay\u0131n sonunda ayl\u0131k olarak i\u015fsizin kendisine \u00f6denir.<\/p>\n<p style=\"text-align: justify;\">\u0130lk i\u015fsizlik \u00f6dene\u011fi \u00f6demesi ise \u00f6dene\u011fe hak kazan\u0131lan tarihi izleyen ay\u0131n sonuna kadar yap\u0131l\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015fsizlik \u00f6dene\u011fi damga vergisi hari\u00e7 herhangi bir vergi ve kesintiye tabi tutulmaz. \u0130\u015fsizlik \u00f6dene\u011fi, nafaka bor\u00e7lar\u0131 d\u0131\u015f\u0131nda haciz veya ba\u015fkas\u0131na devir ve temlik edilemez. Sigortal\u0131n\u0131n kusurundan kaynakland\u0131\u011f\u0131 belirlenen fazla \u00f6demeler yasal faizi ile birlikte geri al\u0131n\u0131r. \u00d6len sigortal\u0131 i\u015fsizlere ait fazla \u00f6demeler geri tahsil edilmez.<\/p>\n<p style=\"text-align: justify;\">Sigortal\u0131, i\u015fsizlik \u00f6dene\u011finden yararlanma s\u00fcresini doldurmadan tekrar i\u015fe girer ve i\u015fsizlik sigortas\u0131 \u00f6dene\u011finden yararlanmak i\u00e7in bu Kanunun \u00f6ng\u00f6rd\u00fc\u011f\u00fc \u015fartlar\u0131 yerine getiremeden yeniden i\u015fsiz kal\u0131rsa, daha \u00f6nce haketti\u011fi i\u015fsizlik \u00f6dene\u011fi s\u00fcresini dolduruncaya kadar bu haktan yararlanmaya devam eder. Bu Kanunun \u00f6ng\u00f6rd\u00fc\u011f\u00fc \u015fartlar\u0131 yerine getirmek suretiyle yeniden i\u015fsiz kal\u0131nmas\u0131 halinde ise sadece bu yeni hak sahipli\u011finden do\u011fan s\u00fcre kadar i\u015fsizlik \u00f6dene\u011fi \u00f6denir.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015fsizlik \u00f6dene\u011fi alanlar\u0131n; i\u015fe al\u0131nd\u0131\u011f\u0131 tarihten \u00f6nceki aydan ba\u015flayarak i\u015fe alan i\u015fyerine ait son alt\u0131 ayl\u0131k d\u00f6nemde, prim ve hizmet belgelerinde bildirilen ortalama sigortal\u0131 say\u0131s\u0131na ilave olarak i\u015fe al\u0131nmas\u0131 kayd\u0131yla, 5510 say\u0131l\u0131 Kanunun 81 inci maddesinde say\u0131lan ve 82 nci maddesi uyar\u0131nca belirlenen prime esas kazan\u00e7 alt s\u0131n\u0131r\u0131 \u00fczerinden hesaplanan k\u0131sa vadeli sigorta primi tutar\u0131n\u0131n y\u00fczde biri olmak \u00fczere i\u015f\u00e7i ve i\u015fveren pay\u0131 sigorta primleri ile genel sa\u011fl\u0131k sigortas\u0131 primi, kalan i\u015fsizlik \u00f6dene\u011fi s\u00fcresince Fondan kar\u015f\u0131lan\u0131r. Bu s\u00fcre ba\u015flang\u0131\u00e7ta belirlenen toplam hak sahipli\u011fi s\u00fcresinden d\u00fc\u015f\u00fcl\u00fcr. S\u00f6z konusu primlerin \u0130\u015fsizlik Sigortas\u0131 Fonundan kar\u015f\u0131lanabilmesi i\u00e7in i\u015fverenlerin \u00e7al\u0131\u015ft\u0131rd\u0131klar\u0131 sigortal\u0131larla ilgili olarak 5510 say\u0131l\u0131 Kanun uyar\u0131nca ayl\u0131k prim ve hizmet belgelerini yasal s\u00fcresi i\u00e7erisinde Sosyal G\u00fcvenlik Kurumuna vermesi, varsa prime esas alt kazan\u00e7 s\u0131n\u0131r\u0131 ile prime esas kazan\u00e7 aras\u0131ndaki fark ve k\u0131sa vadeli sigorta kollar\u0131na ili\u015fkin prim tutar\u0131 fark\u0131 ile i\u015fsizlik sigortas\u0131 primlerini Sosyal G\u00fcvenlik Kurumuna \u00f6demi\u015f olmas\u0131 \u015fartt\u0131r.<\/p>\n<p style=\"text-align: justify;\">Bu maddede d\u00fczenlenen te\u015fvik, 5510 say\u0131l\u0131 Kanun kapsam\u0131nda bulunanlarla ayn\u0131 \u015fartlarda olmak \u00fczere 506 say\u0131l\u0131 Kanunun ge\u00e7ici 20 nci maddesi kapsam\u0131ndaki sand\u0131klar\u0131n stat\u00fclerine tabi personeli i\u00e7in de uygulan\u0131r. Bu maddeyle d\u00fczenlenen destek unsurundan di\u011fer ilgili mevzuat uyar\u0131nca ayr\u0131ca yararlanmakta olan i\u015fverenler; ayn\u0131 d\u00f6nem i\u00e7in ve m\u00fckerrer olarak bu destek unsurundan yararlanamaz. Bu durumda, i\u015fverenlerin tercihleri dikkate al\u0131nmak suretiyle uygulama, destek unsurlar\u0131ndan sadece biriyle s\u0131n\u0131rl\u0131 olarak yap\u0131l\u0131r. Ayr\u0131ca, i\u015f\u00e7inin, i\u015ften ayr\u0131ld\u0131\u011f\u0131 i\u015fyerinde tekrar i\u015fe ba\u015flamas\u0131 halinde bu te\u015fvik h\u00fck\u00fcmlerinden yararlan\u0131lamaz. Bu f\u0131krada d\u00fczenlenen te\u015fvik, 21\/4\/2005 tarihli ve 5335 say\u0131l\u0131 Baz\u0131 Kanun ve Kanun H\u00fckm\u00fcnde Kararnamelerde De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanunun 30 uncu maddesinin ikinci f\u0131kras\u0131 kapsam\u0131na giren kurum ve kurulu\u015flara ait i\u015fyerlerinde \u00e7al\u0131\u015fmaya ba\u015flayanlar hakk\u0131nda uygulanmaz.<\/p>\n<p style=\"text-align: justify;\"><b>\u0130\u015fsizlik \u00f6dene\u011fi ne \u015fekilde hesaplanacak ve nas\u0131l \u00f6denecektir?<br \/>\n<\/b><\/p>\n<p style=\"text-align: justify;\">\u0130\u015fsizlik sigortas\u0131n\u0131n nas\u0131l hesaplanaca\u011f\u0131 hakk\u0131nda \u00f6rneklerle konuyu a\u00e7\u0131klamak gerekirse \u015funlar\u0131 s\u00f6yleyebiliriz.<br \/>\n\u0130\u015fsizlik sigortas\u0131n\u0131n \u00f6denme s\u00fcresi i\u00e7inde \u00f6denmesi gereken ge\u00e7ici i\u015fg\u00f6remezlik \u00f6dene\u011finin miktar\u0131 i\u015fsizlik \u00f6dene\u011fi miktar\u0131ndan fazla olamaz.<br \/>\n\u0130\u015fsizlik maa\u015f\u0131n\u0131 hesaplamada da herkese ayn\u0131 para \u00f6denmeyece\u011finin bilinmesi gerekmektedir. Yani her i\u015fsize ayn\u0131 maa\u015f \u00f6denemeyecektir. Ne kadar i\u015fsizlik maa\u015f\u0131 alaca\u011f\u0131n\u0131z i\u015ften ayr\u0131lmadan \u00f6nceki ald\u0131\u011f\u0131n\u0131z maa\u015f\u0131n\u0131zla alakal\u0131d\u0131r.<\/p>\n<p style=\"text-align: justify;\"><b>\u00d6rnekle bu konuyu anlatmak gerekirse;<br \/>\n<\/b><\/p>\n<p style=\"text-align: justify;\">Sigorta hizmet d\u00f6k\u00fcm\u00fcn\u00fczde g\u00f6r\u00fcnen ald\u0131\u011f\u0131n\u0131z net \u00fccret son 4 ay 900 + 900 + 900 + 900 = 3600 TL son 4 ayda toplam ald\u0131\u011f\u0131n\u0131z para varsayal\u0131m.<\/p>\n<p style=\"text-align: justify;\">Son 4 ayda yat\u0131r\u0131lan paran\u0131n g\u00fcnl\u00fc\u011f\u00fcn\u00fcn bulunmas\u0131 gerekmektedir. Buna g\u00f6re;<br \/>\n3600 \/ (30 g\u00fcn * 4 ay) = 30 TL g\u00fcnl\u00fck kazan\u00e7 olacakt\u0131r.<\/p>\n<p style=\"text-align: justify;\">Ancak, bu paran\u0131n % 40?\u0131n \u00fczerinden i\u015fsizlik maa\u015f\u0131 alacaks\u0131n\u0131z 30 * 0,40 = 12 TL<\/p>\n<p style=\"text-align: justify;\">E\u011fer son 3 y\u0131lda 600 g\u00fcn priminiz varsa 180 g\u00fcn (6 ay); 900 g\u00fcn\u00fcn\u00fcz varsa 240 g\u00fcn, 1080 g\u00fcn ve fazlas\u0131 ise 300 g\u00fcn i\u015fsizlik maa\u015f\u0131 alacaks\u0131n\u0131z.<\/p>\n<p style=\"text-align: justify;\"><b>180 g\u00fcn \u00fczerinden hesaplama yapacak olursak;<\/b><\/p>\n<p style=\"text-align: justify;\">12 TL * 180 g\u00fcn = 2.160 TL toplam i\u015fsizlik \u00f6dene\u011fi alman\u0131z gerekmektedir.<\/p>\n<p style=\"text-align: justify;\">Ayl\u0131k tutar\u0131 bulacak olursak 2.160 TL yi 6 aya b\u00f6lersek<br \/>\n2160 \/ 6 ay= 360 TL ayl\u0131k i\u015fsizlik maa\u015f\u0131n\u0131 6 ay s\u00fcreyle alacaks\u0131n\u0131z.<\/p>\n<p style=\"text-align: justify;\">Alaca\u011f\u0131n\u0131z i\u015fsizlik \u00fccreti ise asgari br\u00fct \u00fccretin %80 inden fazla olamayacakt\u0131r. 2012 y\u0131l\u0131nda asgari \u00fccretin 886,5 TL olmas\u0131 dikkate al\u0131nd\u0131\u011f\u0131nda 886,5*0,80= 709,2 TL den fazla i\u015fsizlik \u00f6dene\u011fi verilemeyecektir.<\/p>\n<p style=\"text-align: justify;\"><b>\u0130\u015fsizlik \u00f6dene\u011fine hak kazanman\u0131n \u015fartlar\u0131 nelerdir?<br \/>\n<\/b><\/p>\n<p style=\"text-align: justify;\">4447 say\u0131l\u0131 Kanun uyar\u0131nca sigortal\u0131 say\u0131lanlardan hizmet akitleri a\u015fa\u011f\u0131da belirtilen hallerden birisine dayal\u0131 olarak sona erenler, T\u00fcrkiye \u0130\u015f Kurumuna s\u00fcresi i\u00e7inde (Sigortal\u0131 i\u015fsizin i\u015ften ayr\u0131ld\u0131\u011f\u0131 tarihten itibaren 30 g\u00fcn i\u00e7inde \u0130\u015eKUR&#8217;un ilgili birimine do\u011frudan veya elektronik ortamda ba\u015fvurmas\u0131) \u015fahsen ba\u015fvurarak yeni bir i\u015f almaya haz\u0131r olduklar\u0131n\u0131 kaydettirmeleri ve bu Kanunda yer alan prim \u00f6deme ko\u015fullar\u0131n\u0131 sa\u011flam\u0131\u015f olmalar\u0131 kayd\u0131yla i\u015fsizlik \u00f6dene\u011fi almaya hak kazan\u0131rlar.<\/p>\n<p style=\"text-align: justify;\">1- 25\/8\/1971 tarihli ve 1475 say\u0131l\u0131 \u0130\u015f Kanununun 13 \u00fcnc\u00fc maddesi veya 20\/4\/1967 tarihli ve 854 say\u0131l\u0131 Deniz \u0130\u015f Kanununun 16 nc\u0131 maddesi yada 13\/6\/1952 tarihli ve 5953 say\u0131l\u0131 Bas\u0131n Mesle\u011finde \u00c7al\u0131\u015fanlarla \u00c7al\u0131\u015ft\u0131ranlar Aras\u0131ndaki M\u00fcnasebetlerin Tanzimi Hakk\u0131nda Kanunun 6 nc\u0131 maddesinin d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131nda belirtilen bildirim \u00f6nellerine uygun olarak hizmet akdi i\u015fveren taraf\u0131ndan sona erdirilmi\u015f olmak.<\/p>\n<p style=\"text-align: justify;\">2- Hizmet akdi, s\u00fcresi belli olsun veya olmas\u0131n s\u00fcrenin bitiminden \u00f6nce veya bildirim \u00f6nelini beklemeksizin 1475 say\u0131l\u0131 \u0130\u015f Kanununun 16 nc\u0131 maddesinin (I), (II) ve (III) numaral\u0131 bentlerine veya 854 say\u0131l\u0131 Deniz \u0130\u015f Kanununun 14 \u00fcnc\u00fc maddesinin (II) ve (III) numaral\u0131 bentlerine veya 5953 say\u0131l\u0131 Bas\u0131n Mesle\u011finde \u00c7al\u0131\u015fanlarla \u00c7al\u0131\u015ft\u0131ranlar Aras\u0131ndaki M\u00fcnasebetlerin Tanzimi Hakk\u0131nda Kanunun 7 nci maddesi ile 11 inci maddesinin birinci f\u0131kras\u0131na g\u00f6re sigortal\u0131 taraf\u0131ndan feshedilmi\u015f olmak.<\/p>\n<p style=\"text-align: justify;\">3- Hizmet akdi, s\u00fcresi belli olsun veya olmas\u0131n s\u00fcresinin bitiminden \u00f6nce veya bildirim \u00f6nelini beklemeksizin 1475 say\u0131l\u0131 \u0130\u015f Kanununun 17 nci maddesinin (I) ve (III) numaral\u0131 bentlerine veya 854 say\u0131l\u0131 Deniz \u0130\u015f Kanununun 14 \u00fcnc\u00fc maddesinin (III) numaral\u0131 bendine veya 5953 say\u0131l\u0131 Bas\u0131n Mesle\u011finde \u00c7al\u0131\u015fanlarla \u00c7al\u0131\u015ft\u0131ranlar Aras\u0131ndaki M\u00fcnasebetlerin Tanzimi Hakk\u0131nda Kanunun 12 inci maddesinin birinci f\u0131kras\u0131na g\u00f6re i\u015fveren taraf\u0131ndan feshedilmi\u015f olmak.<\/p>\n<p style=\"text-align: justify;\">4- Hizmet akdinin belirli s\u00fcreli olmas\u0131 halinde, bu s\u00fcrenin bitimi nedeniyle i\u015fsiz kalmak, 854 say\u0131l\u0131 Deniz \u0130\u015f Kanununun 7 nci maddesinin (II) numaral\u0131 bendinde belirtilen hizmet akdinin belirli bir sefer i\u00e7in yap\u0131lm\u0131\u015f olmas\u0131 nedeniyle sefer sonunda i\u015fsiz kalmak.<\/p>\n<p style=\"text-align: justify;\">5- \u0130\u015fyerinin el de\u011fi\u015ftirmesi veya ba\u015fkas\u0131na ge\u00e7mesi, kapanmas\u0131 veya kapat\u0131lmas\u0131, i\u015fin veya i\u015fyerinin niteli\u011finin de\u011fi\u015fmesi nedenleriyle i\u015ften \u00e7\u0131kar\u0131lm\u0131\u015f olmak, 854 say\u0131l\u0131 Deniz \u0130\u015f Kanununun 14 \u00fcnc\u00fc maddesinin (IV) numaral\u0131 bendindeki nedenlerle i\u015fsiz kalmak.<\/p>\n<p style=\"text-align: justify;\">6- 24\/11\/1994 tarihli ve 4046 say\u0131l\u0131 \u00d6zelle\u015ftirme Uygulamalar\u0131n\u0131n D\u00fczenlenmesine ve Baz\u0131 Kanun ve Kanun H\u00fckm\u00fcnde Kararnamelerde De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanunun 21 inci maddesi kapsam\u0131nda i\u015fsiz kalmak.<\/p>\n<p style=\"text-align: justify;\">7- Yukar\u0131daki bentlerde belirtilen i\u015f kanunlar\u0131 kapsam\u0131na girmeyen sigortal\u0131lardan hizmet akitleri, 2821 say\u0131l\u0131 Sendikalar Kanunu ile 2822 say\u0131l\u0131 Toplu \u0130\u015f S\u00f6zle\u015fmesi Grev ve Lokavt Kanunu kapsam\u0131nda yap\u0131lm\u0131\u015f olan toplu i\u015f s\u00f6zle\u015fmeleri veya toplu i\u015f s\u00f6zle\u015fmesi bulunmayan hallerde Bor\u00e7lar Kanunu h\u00fck\u00fcmleri do\u011frultusunda (1), (2), (3), (4) ve (5) inci maddelerdeki h\u00fck\u00fcmlere paralel olarak sona ermi\u015f olmak.<br \/>\nAncak, i\u015fsizlik \u00f6dene\u011fine hak kazanabilmek i\u00e7in hizmet akdinin ba\u015fvuru s\u0131ras\u0131nda grev, lokavt veya kanundan do\u011fan \u00f6devler nedeniyle ask\u0131ya al\u0131nmam\u0131\u015f olmas\u0131 gerekmektedir.<\/p>\n<p style=\"text-align: justify;\"><b>\u0130\u015fsizlik \u00f6dene\u011fi \u00f6denmesinde hak d\u00fc\u015f\u00fcr\u00fcc\u00fc nedenler varm\u0131d\u0131r?<br \/>\n<\/b><\/p>\n<p style=\"text-align: justify;\">\u0130\u015fsizlik \u00f6dene\u011fi almakta iken a\u015fa\u011f\u0131daki \u015fartlara uymayan i\u015fsizlerin \u00f6denekleri kesilir.<\/p>\n<p style=\"text-align: justify;\">1- Kurumca teklif edilen mesleklerine uygun ve son \u00e7al\u0131\u015ft\u0131klar\u0131 i\u015fin \u00fccret ve \u00e7al\u0131\u015fma ko\u015fullar\u0131na yak\u0131n ve ikamet edilen yerin belediye m\u00fccavir alan\u0131 s\u0131n\u0131rlar\u0131 i\u00e7inde bir i\u015fi hakl\u0131 bir nedene dayanmaks\u0131z\u0131n reddetmek.<\/p>\n<p style=\"text-align: justify;\">2- \u0130\u015fsizlik \u00f6dene\u011fi ald\u0131\u011f\u0131 s\u00fcrede gelir getirici bir i\u015fte \u00e7al\u0131\u015ft\u0131\u011f\u0131 veya herhangi bir sosyal g\u00fcvenlik kurulu\u015fundan ya\u015fl\u0131l\u0131k ayl\u0131\u011f\u0131 ald\u0131\u011f\u0131 tespit edilmek.<\/p>\n<p style=\"text-align: justify;\">3- T\u00fcrkiye \u0130\u015f Kurumu taraf\u0131ndan \u00f6nerilen meslek geli\u015ftirme, edindirme ve yeti\u015ftirme e\u011fitimini hakl\u0131 bir neden g\u00f6stermeden reddeden veya kabul etmesine kar\u015f\u0131n devam etmemek.<\/p>\n<p style=\"text-align: justify;\">4- Hakl\u0131 bir nedene dayanmaks\u0131z\u0131n T\u00fcrkiye \u0130\u015f Kurumu taraf\u0131ndan yap\u0131lan
