Y\u0131ll\u0131k izinler \u00e7al\u0131\u015fanlar\u0131n tam bir iyilik haline eri\u015fmesinde \u00f6nemli bir rol oynamaktad\u0131r.<\/div>\n<div style=\"text-align: justify;\">4857 say\u0131l\u0131 \u0130\u015f Kanun\u2019a g\u00f6re i\u015fyerinde i\u015fe ba\u015flad\u0131\u011f\u0131 g\u00fcnden itibaren, deneme s\u00fcresi de i\u00e7inde olmak \u00fczere, en az bir y\u0131l \u00e7al\u0131\u015fm\u0131\u015f olan i\u015f\u00e7ilere y\u0131ll\u0131k \u00fccretli izin verilir. \u00c7al\u0131\u015fan y\u0131ll\u0131k \u00fccretli izin hakk\u0131ndan vazge\u00e7emez. Y\u0131ll\u0131k izin s\u00fcreleri ne kadar olmal\u0131d\u0131r? \u00c7al\u0131\u015fanlara verilecek y\u0131ll\u0131k \u00fccretli izin s\u00fcresi, hizmet s\u00fcresi ile ili\u015fkilendirerek belirlenmi\u015ftir. Buna g\u00f6re;<\/div>\n<div style=\"text-align: justify;\">\u25cf Bir y\u0131ldan be\u015f y\u0131la kadar (be\u015f y\u0131l dahil) olanlara 14 g\u00fcnden,<br \/>\n\u25cf Be\u015f y\u0131ldan fazla onbe\u015f y\u0131ldan az olanlara 20 g\u00fcnden,<br \/>\n\u25cf Onbe\u015f y\u0131l (dahil) ve daha fazla olanlara 26 g\u00fcnden, az olamaz. Ancak 18 ve daha k\u00fc\u00e7\u00fck ya\u015ftaki i\u015f\u00e7ilerle 50 ve daha yukar\u0131 ya\u015ftaki \u00e7al\u0131\u015fanlara verilecek y\u0131ll\u0131k \u00fccretli izin s\u00fcresi 20 g\u00fcnden az olamaz. Hafta tatilleri ile ulusal bayram ve genel tatil g\u00fcnleri y\u0131ll\u0131k izin s\u00fcresinden say\u0131lmaz.<\/div>\n<div style=\"text-align: justify;\"><strong>Y\u0131ll\u0131k izne hak kazanma ve iznin kullan\u0131lmas\u0131\u00a0<\/strong><\/div>\n<div style=\"text-align: justify;\">Y\u0131ll\u0131k \u00fccretli izine hak kazanmak i\u00e7in gerekli s\u00fcrenin hesab\u0131nda \u00e7al\u0131\u015fanlar\u0131n, ayn\u0131 i\u015fverenin bir veya \u00e7e\u015fitli i\u015fyerlerinde \u00e7al\u0131\u015ft\u0131klar\u0131 s\u00fcreler birle\u015ftirilerek g\u00f6z \u00f6n\u00fcne al\u0131n\u0131r. \u00c7al\u0131\u015fan, hak etti\u011fi y\u0131ll\u0131k \u00fccretli iznini, kullanmak istedi\u011fi zamandan en az bir ay \u00f6nce i\u015fverene yaz\u0131l\u0131 olarak bildirir. Bu istek, \u00e7al\u0131\u015fan say\u0131s\u0131 y\u00fczden fazla olan i\u015fyerlerinde \u0130zin Kurulu\u2019na bildirilir, e\u011fer \u0130zin Kurulu yoksa i\u015fverenlik\u00e7e g\u00f6revlendirilen bir ki\u015fi ve \u00e7al\u0131\u015fanlar\u0131n kendi aralar\u0131nda se\u00e7ecekleri temsilciye bildirilir.<\/div>\n<div style=\"text-align: justify;\">Y\u0131ll\u0131k \u00fccretli izin i\u015fveren taraf\u0131ndan b\u00f6l\u00fcnemez. Kanun koyucu y\u0131ll\u0131k \u00fccretli izinlerin i\u015fveren taraf\u0131ndan s\u00fcrekli bir \u015fekilde verilmesi gerekti\u011fini belirtmi\u015ftir. Ancak istisnai bir hal olarak, \u00e7al\u0131\u015fan\u0131n talebi de g\u00f6zetilerek tarafl ar\u0131n anla\u015fmas\u0131 ile bir b\u00f6l\u00fcm\u00fc on g\u00fcnden a\u015fa\u011f\u0131 olmamak \u00fczere en \u00e7ok \u00fc\u00e7e b\u00f6l\u00fcnebilir.<\/div>\n<div style=\"text-align: justify;\">Dolay\u0131s\u0131yla uygulamada s\u0131kl\u0131kla g\u00f6r\u00fclen y\u0131ll\u0131k izinlerin 1\u2019er ya da 2\u2019 \u015fer g\u00fcn kulland\u0131r\u0131lmas\u0131 ge\u00e7erli olmayacak ve bu s\u00fcreler i\u015fverenlik taraf\u0131ndan verilen idari izin say\u0131labilecektir.<br \/>\nAyn\u0131 zamanda \u0130\u015fveren taraf\u0131ndan y\u0131l i\u00e7inde verilmi\u015f bulunan di\u011fer \u00fccretli ve \u00fccretsiz izinler veya dinlenme ve hastal\u0131k izinleri y\u0131ll\u0131k izne mahsup edilemez.<\/div>\n<div style=\"text-align: justify;\">\u00c7al\u0131\u015fanlar, y\u0131ll\u0131k \u00fccretli izinlerini i\u015fyerinin kurulu bulundu\u011fu yerden ba\u015fka bir yerde ge\u00e7irecekse ve istemde bulunmalar\u0131 ve bu hususu belgelemeleri ko\u015fulu ile gidi\u015f ve d\u00f6n\u00fc\u015flerinde yolda ge\u00e7ecek s\u00fcreleri kar\u015f\u0131lamak \u00fczere i\u015fveren toplam d\u00f6rt g\u00fcne kadar \u00fccretsiz izin vermek zorundad\u0131r. \u0130\u015fveren de bu s\u00fcrelerin kulland\u0131r\u0131ld\u0131\u011f\u0131na ili\u015fkin belgeyi tutmak zorundad\u0131r.<\/div>\n<p style=\"text-align: justify;\">Y\u0131ll\u0131k \u00fccretli izinle ilgili olarak \u0130\u015f Kanunu\u2019na g\u00f6re; y\u0131ll\u0131k \u00fccretli izni yasaya ayk\u0131r\u0131 \u015fekilde b\u00f6len, izin \u00fccretini yasaya ayk\u0131r\u0131 \u015fekilde \u00f6deyen veya eksik \u00f6deyen, i\u015f s\u00f6zle\u015fmesi feshedilen i\u015f\u00e7iye y\u0131ll\u0131k izin \u00fccreti \u00f6demeyen, y\u0131ll\u0131k izin y\u00f6netmeli\u011finin esas usullerine ayk\u0131r\u0131 olarak izni kulland\u0131rmayan veya eksik kulland\u0131ran i\u015fveren veya i\u015fveren vekiline 2014 y\u0131l\u0131nda her i\u015f\u00e7i i\u00e7in 246 TL idari para cezas\u0131 uygulanabilecektir.<\/p>\n<p style=\"text-align: justify;\">RESUL KURT \/ D\u00dcNYA<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Sa\u011fl\u0131k; yaln\u0131z hastal\u0131k ve sakatl\u0131\u011f\u0131n olmamas\u0131 de\u011fil, fiziksel, ruhsal ve sosyal y\u00f6nden tam biri iyilik halidir (D\u00fcnya Sa\u011fl\u0131k \u00d6rg\u00fct\u00fc`n\u00fcn tan\u0131m\u0131).
