Belirsiz s\u00fcreli i\u015f s\u00f6zle\u015fmelerinin feshinden \u00f6nce durumun di\u011fer tarafa bildirilmesi gerekir.<\/strong><strong><br \/>\n<strong>\u0130\u015f s\u00f6zle\u015fmeleri;<\/strong><br \/>\n<strong>a) \u0130\u015fi alt\u0131 aydan az s\u00fcrm\u00fc\u015f olan i\u015f\u00e7i i\u00e7in, bildirimin di\u011fer tarafa yap\u0131lmas\u0131ndan ba\u015flayarak iki hafta sonra,<\/strong><span class=\"apple-converted-space\">\u00a0<\/span><br \/>\n<strong>b) \u0130\u015fi alt\u0131 aydan birbu\u00e7uk y\u0131la kadar s\u00fcrm\u00fc\u015f olan i\u015f\u00e7i i\u00e7in, bildirimin di\u011fer tarafa yap\u0131lmas\u0131ndan ba\u015flayarak d\u00f6rt hafta sonra,<\/strong><br \/>\n<strong>c) \u0130\u015fi birbu\u00e7uk y\u0131ldan \u00fc\u00e7 y\u0131la kadar s\u00fcrm\u00fc\u015f olan i\u015f\u00e7i i\u00e7in, bildirimin di\u011fer tarafa yap\u0131lmas\u0131ndan ba\u015flayarak alt\u0131 hafta sonra,<\/strong><span class=\"apple-converted-space\">\u00a0<\/span><br \/>\n<strong>d) \u0130\u015fi \u00fc\u00e7 y\u0131ldan fazla s\u00fcrm\u00fc\u015f i\u015f\u00e7i i\u00e7in, bildirim yap\u0131lmas\u0131ndan ba\u015flayarak sekiz hafta sonra,<\/strong><br \/>\n<strong>Feshedilmi\u015f say\u0131l\u0131r.<\/strong><span class=\"apple-converted-space\">\u00a0<\/span><br \/>\n<strong>Bu s\u00fcreler asgari olup s\u00f6zle\u015fmeler ile art\u0131r\u0131labilir.<\/strong><\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Yarg\u0131tay\u2019\u0131n bu y\u00f6nde kararlar\u0131 da bulunuyor.<span class=\"apple-converted-space\"><strong>\u00a0<\/strong><\/span><strong>\u00d6rnek kararlar\u0131n bir tanesin de \u201ci\u015f\u00e7inin raporlu ve istirahatl\u0131 ge\u00e7irdi\u011fi s\u00fcre normal ihbar s\u00fcresini a\u015ft\u0131\u011f\u0131nda i\u015fverenin ihbars\u0131z fesih hakk\u0131 do\u011far \u015feklindedir\u201d<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>\u00d6rne\u011fin:<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>(A)Ltd.\u015eti \u00e7al\u0131\u015fan\u0131 Hasan Bey, bir y\u0131ld\u0131r \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015fyerinden rahats\u0131zl\u0131\u011f\u0131 sonucu 90 g\u00fcnl\u00fck sa\u011fl\u0131k raporu alm\u0131\u015ft\u0131r. \u0130\u015fveren Hasan Beyi ne zaman i\u015ften \u00e7\u0131karma hakk\u0131 ortaya \u00e7\u0131kabilir?<\/strong><strong><br \/>\n<\/strong>Hasan\u00a0 Beyin<span class=\"apple-converted-space\"><strong>\u00a0<\/strong><\/span><strong>ihbar s\u00fcresi+6 hafta form\u00fcl\u00fcne g\u00f6re i\u015flem yapar isek<\/strong>;<\/span><br \/>\n<span style=\"color: #000000;\"><strong>1 y\u0131ll\u0131k k\u0131demine kar\u015f\u0131l\u0131k 4 hafta+6 hafta=10 hafta*7 g\u00fcn=70 g\u00fcn sonra i\u015f akdi fesih edilir.<\/strong><strong><br \/>\n<\/strong>Hasan Bey\u2019in i\u015f akdi 70. g\u00fcnden sonra i\u015ften \u00e7\u0131karabilir.\u015eayet Hasan Bey,<span class=\"apple-converted-space\">\u00a0<\/span><strong>70 G\u00fcnl\u00fck s\u00fcre dolmadan i\u015ften \u00e7\u0131kar\u0131l\u0131rsa i\u015fveren ihbar \u00f6neli+6 hafta s\u00fcresine uymad\u0131\u011f\u0131 i\u00e7in ihbar tazminat\u0131 \u00f6demek zorunda kal\u0131r. Hastal\u0131\u011f\u0131ndan dolay\u0131 Hasan Beyin, 70 g\u00fcn\u00fc dolduktan sonra veya dolmadan i\u015ften \u00e7\u0131kar\u0131l\u0131rsa her durumda k\u0131dem tazminat\u0131na hak kazanacakt\u0131r.
